Legal requirements in making a Will

Although there is some divergence between the various State statutes concerning execution requirements, in all States, a Will must be signed by the patient in the presence of at least two adult independent witnesses, who must also sign the Will as an act of attestation of their having seen the signing, in the presence of the patient.

Where a patient is physically unable to sign their Will, the patient may direct another person to sign the Will on the patient’s behalf, provided the Will is signed in the presence of the patient and all other legal requirements are satisfied.
